General Agreement

These Terms of Use govern your access to and use of the Camp Yellow Cardinal website and its content, features, and related online services, collectively referred to as the “Site.”

The Site is operated by Camp Yellow Cardinal, LLC (“Camp Yellow Cardinal,” “we,” “us,” or “our”).

By accessing or using the Site, you acknowledge that you have read and agree to these Terms of Use. If you do not agree to these Terms, you should not use the Site.

Scope of These Terms

These Terms govern use of the Site. They do not contain all terms applicable to a reservation or stay at Camp Yellow Cardinal.

Reservations and stays are governed by our Guest Terms & Conditions, including the Cancellation & Rescheduling Policy, and by any rate-plan terms, policies, or notices displayed during the booking process.

Our collection and use of personal information are described in our Privacy Policy.

Permitted Use of the Site

Camp Yellow Cardinal grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Site for lawful, personal, and noncommercial purposes. You agree not to:

Use the Site for any unlawful, fraudulent, or unauthorized purpose
Interfere with the operation, security, or availability of the Site
Attempt to gain unauthorized access to the Site, its systems, or information
Introduce viruses, malicious code, automated scripts, or other harmful technology
Use bots, scrapers, crawlers, or similar automated methods to access or collect Site content without our written permission
Impersonate another person or misrepresent your identity or affiliation
Use the Site in a manner that infringes the rights of Camp Yellow Cardinal or another person
Copy, reproduce, distribute, modify, republish, or commercially exploit Site content except as expressly permitted by these Terms or applicable law

We may restrict or terminate access to the Site if we reasonably believe a user has violated these Terms or has used the Site in a harmful or unlawful manner.

Intellectual Property

The Site and its content, including text, photographs, graphics, logos, designs, videos, illustrations, page layouts, branding, and other materials, are owned by or licensed to Camp Yellow Cardinal and are protected by applicable copyright, trademark, and other intellectual-property laws.

You may view and use Site content for personal, noncommercial purposes. You may not reproduce, modify, distribute, publicly display, publish, sell, license, create derivative works from, or otherwise exploit Site content without prior written permission from Camp Yellow Cardinal or the applicable rights holder.

Nothing in these Terms transfers ownership of any Site content or intellectual property to you.

Information You Provide

When you submit an inquiry, join our mailing list, provide feedback, or otherwise communicate with us through the Site, you agree to provide information that is accurate and not misleading. You may not submit content that:

Violates applicable law
Infringes another person’s rights
Contains malicious code
Is fraudulent, threatening, harassing, defamatory, or otherwise harmful
Contains personal information about another person without appropriate authorization

If you voluntarily provide suggestions, ideas, or feedback about Camp Yellow Cardinal or the Site, we may use that feedback for business and operational purposes without an obligation to compensate you, provided that our use remains subject to our Privacy Policy and applicable law.

Website Information & Availabilty

We work to keep the Site accurate, current, and available. However, information may occasionally contain errors, omissions, or outdated material. Information displayed on the Site regarding accommodations, amenities, availability, pricing, policies, construction progress, nearby attractions, or other matters may change. Reservation prices, availability, taxes, policies, and other binding booking terms are those presented and confirmed during the reservation process. We may update, modify, suspend, or discontinue any part of the Site without prior notice. We do not guarantee that the Site will always be uninterrupted, secure, or free from technical problems. If Site information conflicts with the terms displayed for a confirmed reservation, the reservation confirmation, applicable rate-plan terms, and Guest Terms & Conditions will control with respect to that reservation.

Third-Party Websites & Services

The Site may contain links to websites, booking services, maps, social-media platforms, payment providers, or other services operated by third parties.

Camp Yellow Cardinal does not control and is not responsible for the content, security, availability, products, services, or privacy practices of third-party websites or services. The inclusion of a link does not necessarily constitute an endorsement.

Your use of a third-party website or service is governed by that third party’s own terms and privacy policies. We encourage you to review those documents before providing information or completing a transaction.

Electronic Communication

When you contact us electronically or use features of the Site, you agree that we may respond and provide notices, disclosures, or other communications electronically, including by email.

Electronic communications may satisfy requirements that a communication be provided in writing to the extent permitted by applicable law. Virginia law generally recognizes the legal effect of electronic records and contracts and does not deny enforceability solely because they are in electronic form.

Reservation-related email and text communications are governed by the Guest Terms & Conditions and Privacy Policy. Marketing communications are governed by the permissions and preferences you provide.

Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis. Camp Yellow Cardinal does not make warranties or representations that:

The Site will always be available, uninterrupted, secure, or error-free
Site content will always be complete, accurate, or current
Defects or technical problems will always be corrected
The Site or its servers will be free from viruses or other harmful components
Information on the Site will meet every user’s particular needs or expectations

Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Camp Yellow Cardinal and its owners, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to:

Your use of or inability to use the Site
Reliance on information displayed on the Site
Unauthorized access to or alteration of information transmitted through the Site
The conduct, content, products, or services of a third party
A temporary interruption, error, or security incident affecting the Site

This limitation applies regardless of the legal theory asserted and whether Camp Yellow Cardinal was advised that such damages were possible. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law. Reservation, property-use, personal-injury, and stay-related matters are governed separately by the Guest Terms & Conditions and applicable law.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Camp Yellow Cardinal and its owners, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising from:

Your unlawful or unauthorized use of the Site
Your violation of these Terms
Your infringement of another person’s rights
Content or information you submit through the Site in violation of these Terms

Camp Yellow Cardinal reserves the right to assume control of the defense of a claim subject to indemnification. You agree to provide reasonable cooperation in that defense.

Suspension or Termination

We may suspend or terminate your access to all or part of the Site if we reasonably believe that you:

Violated these Terms
Used the Site unlawfully or fraudulently
Created a security risk
Interfered with the Site or another user’s access
Engaged in conduct harmful to Camp Yellow Cardinal, its guests, or its service providers

Sections that by their nature should survive termination, including intellectual-property, disclaimer, liability, indemnification, and governing-law provisions, will remain effective.

Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Any legal proceeding arising solely from the use of the Site that is not governed by a separate enforceable agreement must be brought in a state or federal court with proper jurisdiction and venue in Virginia.

Applicable consumer protections and venue rules that cannot lawfully be changed by agreement remain unaffected. Virginia law permits contractual choice-of-law provisions subject to limitations that apply to consumer contracts and nonwaivable legal protections.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified as necessary to reflect its intended purpose.

The remaining provisions will continue in full force and effect.

No Waiver

A failure by Camp Yellow Cardinal to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Camp Yellow Cardinal regarding use of the Site. Reservations and stays are also governed by the Guest Terms & Conditions, applicable rate-plan terms, and other policies presented during booking.

Changes to These Terms

We may update these Terms periodically to reflect changes in the Site, our practices, or applicable legal requirements.

When we make changes, we will post the revised Terms on this page and update the “Last Updated” date. Changes become effective when posted unless otherwise stated.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.
